As you have seen in many recent letters from me, our court is not immune from the Coronavirus. A number of employees, visitors, and security personnel have tested positive.

Court History Seminar: Chicago Seven Trial 50 Years Later
A Conversation with Trial Prosecutor Richard Schultz- The Court recently sponsored, along with the Federal Bar Association and the Seventh Circuit Bar Association, a recorded interview of Richard Schultz, one of the prosecutors in the Chicago 7 trial. The link to that interview is on the Court's website. The trial was controversial when it took place over 50 years ago, and remains controversial today. In posting a link to the video on its website, the Court is not endorsing the views of any of the trial participants. Many of the defendants and defense counsel have written and spoken about the case over the years since the trial took place. Mr. Schultz has not done so to any great degree up until now, and his perspective adds to our understanding of this chapter in this Court's long and storied history.

SCAM ALERT: U.S. District Court for the Northern District of Illinois Clerk of Court’s Office Urges Public to Report Phone Scams

 

The Clerk of Court’s Office for the U.S. District Court for the Northern District of Illinois, the U.S. Marshals Service, and the FBI are alerting the public of several imposter scams targeting residents of the Northern District of Illinois involving individuals claiming to be officers of the court, U.S. Marshals, or other law enforcement officials. During these calls, scammers attempt to collect a fine in lieu of arrest for failing to report for jury duty or other offenses.

Kendall ruled that the Sheriff of Cook County and the Cook County Department of Corrections (CCDOC) were in compliance with a 2010 consent order, granting a motion to dismiss the Sheriff of Cook County and CCDOC from a 2010 civil lawsuit and subsequent consent order, effectively ending federal oversight of CCDOC.

New Origin Code – Multi-District Litigation (MDL)

Pursuant to the Judicial Conference, a new Origin Code has been created to identify the MDL cases originating in the same district as the lead/master MDL case. This will be referred to as " Direct File" MDL cases. The new origin code," 8. Multidistrict Litigation – Direct File", has been created and added to the JS 44. The new version of the JS 44 is archively available on our site and can be found here .

Origin code "8. Multidistrict Litigation – Direct File" will be assigned to all MDL cases that opened on or after July 1, 2016, and originated in the transferee court. MDL cases originating prior to July 1, 2016 will continue to be identified with origin code "6. Multidistrict Litigation – Transfer".

New Civil Nature of Suit Code - Qui Tam Cases

Pursuant to the Judicial Conference, a new civil nature of suit (NOS) code has been created to identify unsealed qui tam cases to address CJRA reporting. The NOS code 376, Qui Tam (31 U.S.C. Section 3729(a), has been added to the Civil Cover Sheet (Form JS (ILND) 44). The NOS code is to be assigned to a case when a private citizen originates the qui tam case. If the government assumes the case (i.e., U.S. Attorney begins to handle the case for the plaintiff), the same NOS code should be assigned to that case.

New Procedure for Attorneys when Filing a Motion to Withdraw
Effective immediately, when a party’s attorney files a motion to withdraw from a case and no other attorney of record is associated with that party, the attorney must attach the Notification of Party Contact Information Form. The form should be electronically filed as an attachment to the motion to withdraw. This will allow the Clerk’s Office to have a mechanism to communicate with the party should the motion be granted. Beginning on July 15, 2013, the United States District Court for the Northern District of Illinois will discontinue the use of the "minute order=" form. That form, which worked well in the days before e-filing, is no longer necessary. The District Court will now use a standard order form in which the docket text entry (what once appeared in a box near the top of the minute order form) will appear near the top, labeled "Order." If any additional discussion or explanation is needed, that additional language will appear below, in a section labeled "Statement." To view examples of the new order format click here .
An additional change to our Court's docketing practice is that we will no longer create a separate pdf version of the minute entries that require no corresponding order. All docket entries will still generate an e-mailed notice of electronic filing.

He attended the University of Chicago Law School and graduated with honors. Shah and his wife Joanna Grisinger, who teaches at Northwestern University, archively live in Chicago. After law school, Shah was a litigation associate at Heller Ehrman in San Francisco and clerked for Hon. James B. Zagel of the United States District Court for the Northern District of Illinois. Shah joined the Chicago U.S. Attorney’s Office in September 2001 and prosecuted violent crime, international drug trafficking, complex fraud and public corruption. Together with a team of prosecutors and federal agents, he investigated and prosecuted a series of cases arising out of the City of Chicago’s Hired Truck Program and Office of Intergovernmental Affairs. During his career at the U.S. Attorney’s Office Shah served in several leadership positions. He was a Deputy Chief of the General Crimes Section and the Financial Crimes and Special Prosecutions Section, and he was the Chief of the Appellate Section. archively, Shah is the Chief of the Criminal Division and is responsible for supervising the prosecutions in the Northern District of Illinois handled by the approximately 130 Assistant United States Attorneys.

New $400 Federal Civil Case Filing Fee Starting May 1, 2013
The Judicial Conference of the United States has increased the mandatory civil case filing fee to $400 by adding a $50 administrative fee starting May 1, 2013 for any new civil case filed in United States District Courts across the country. This fee does not apply to persons granted in forma pauperis status under 28 U.S.C. § 1915. The Northern District of Illinois will update its fee schedule according to the new policy. All counsel and parties are therefore notified that effective May 1, 2013, the filing fee to be paid when a new civil case is filed in the United States District Court for the Northern District of Illinois is $400.

The court has adopted a Model Confidentiality Order to facilitate the exchange of discovery materials that are entitled to protection under Federal Rule of Civil Procedure 26. The model order is for the convenience of the parties and the court and not intended to create a presumption in favor of the provisions in the model and against alternative language that the parties may propose. To simplify the court’s review, however, draft confidentiality orders proposed by the parties must show changes from the model order by redlining that indicates both deletions and additions to the model text.
