All new cases must have a civil cover sheet (form ILND 44). On the civil cover sheet, in Section IX, the filer should list Judge Mary Rowland and that the case is related to master docket number 23 CV 0818 and MDL 3060. (See the Court's May 2, 2023 Minute Order, available at No. 23 CV 818, Dkt. 95). There are currently two ways lawsuits can get to this MDL: (1) you can file your lawsuit in another federal court or District before it is transferred to this District; or (2) you can directly file a lawsuit in this District under the terms of the direct filing order (Case Management Order ("CMO") No. 2). The procedure for filing a lawsuit involves the filing of a Civil Cover Sheet (see Local Rule 3.1) and Complaint and having Summonses issued for each Defendant. For lawsuits naming Revlon as a defendant, Plaintiffs can file only in the MDL (using option #2, above) and consistent with the bankruptcy court's order regarding such claims (see Order, Docket No. 1746, In re: Revlon, Inc. et al., Case No. 22-10760-DSJ (S.D.N.Y.)).

Directly Filed Complaints: When filing a new complaint, NEVER FILE THE NEW COMPLAINT UNDER THE MASTER CASE NUMBER (23 CV 818). The proper procedure for directly filing new complaints in the Northern District of Illinois is outlined in Case Management Order Nos. 2 and 3 (also available via the MDL 3060 web page), and the Court's May 2, 2023 Minute Order (available at Dkt. 95). All new complaints are filed like any other new complaint in the Northern District of Illinois, with two important differences:

Per CMO No. 2 and Dkt. 95: Any new complaint must be filed as a new case in the Northern District of Illinois, with a notation on this district's civil cover sheet indicating the relationship of the newly filed case to this MDL proceeding. The newly filed case will receive its own docket number (as a new "member case") and the Court's Clerk's Office will directly transfer the case to this MDL. At the bottom of the Civil Cover Sheet under Section IX, the attorney should list Judge Mary Rowland and that the case is related to master docket number 23 CV 0818. All plaintiffs directly filing in the MDL are required to pay the standard New Action Filing Fee ($402) to initiate the case.

Yes. Plaintiffs shall file and serve a Short Form Complaint in every action that is directly filed in this MDL. The Court approved the Short Form Complaint on August 3, 2023 and it is subject to Case Management Order No. 7 which sets forth the parameters for its use. The Short Form Complaint is available also under "Forms" on the MDL webpage.

No, CMO No. 2 provides a detailed explanation, but you do not need to be admitted Pro Hac Vice. Pro hac vice requirements (and the payment of associated fees) are waived for any attorney who has filed an appearance in a transferor court. Attorneys admitted to practice and in good standing in any United States District Court may be admitted pro hac vice in this litigation without the payment of the pro hac vice fee and without associating local counsel. You will however need to link your NextGen Pacer account to the Northern District of Illinois in order to file. Contact Pacer if you are having issues with this process. Whether or not they file appearances in this case, all lawyers in this litigation are expected to comply with the Court's Local Rules and to abide by the terms of the case management orders and protective orders.

A motion to withdraw must be filed. If granting the motion to withdraw will leave other counsel of record representing the plaintiff, the motion should so state. In such circumstances, the Court likely will grant the motion without requiring any appearance. However if granting the motion will leave no other counsel of record representing the plaintiff, the motion must clearly so state, the motion must list the contact information for the plaintiff (name, address, and telephone number), the motion must be accompanied by a notice of motion, and the certificate of service must reflect service of the motion and notice of motion upon the plaintiff. The motion also must state, in detail, the basis for the requested withdrawal. In that circumstance the Court likely will require counsel appear in person or via WebEx at the hearing on the motion.
