The amendment places the burden of policing the disposition of restricted documents where the Court believes it belongs: on the parties who sought to have the documents restricted. The proposal would give the parties 63 days after closing including completion of appeals that did not result in the case being reopened to petition for return or destruction of the restricted documents. If no action is taken by parties with the 63-day period, the presumption of the public nature of the proceedings takes effect.
