Rule 30 Transfers And Remands Of Cases

A. Transfers under 28 U.S.C. §§1404, 1406, 1412

When an order is entered directing the clerk to transfer a case to another district pursuant to the provisions of 28 U.S.C. §1404, 1406, or 1412, the clerk shall delay the transfer of the case for fourteen days following the date of docketing the order of transfer, provided that where the Court directs that the case be transferred forthwith, no such delay shall be made. In effecting the transfer, the clerk shall transmit the original of all documents, including the order of transfer, and a certified copy of the docket. The clerk shall note on the docket the date of the transfer.

B. Remands of Removals under 28 U.S.C. §1447

When an order is entered directing that a case be remanded to a State court pursuant to 28 U.S.C. §1447(c) the clerk shall delay mailing the certified copy of the remand order for fourteen days following the date of docketing the order of transfer, provided that where the Court directs that the copy by mailed forthwith, no such delay shall be made.

C. Motions for Reconsideration of Transfer and Remand Orders: Extensions of Time to File

The filing of a petition for reconsideration of an order of transfer or an order of remand referred to in sections (A) and (B) of this Rule, respectively, shall not serve to stop the transfer or remand of the case. The court on its own motion or on motion of the party filing a petition for reconsideration may direct the clerk not to complete the transfer or remand process until a date certain or further order of court.
