Rule 22 Notice Of Claim Of Unconstitutionality

A. Advising The Court

In order to assist the court in its statutory duty under 28 U.S.C. §2403, counsel raising a question of the constitutionality of an Act of Congress affecting the public interest shall promptly advise the court in writing of such fact.

B. Notification By The Clerk

Upon receipt of such notice, the court shall order the clerk to make a certificate in the following form:

The Attorney General of the U.S. is hereby notified that the constitutionality of an act of Congress affecting the public interest (Section _____, Title ____, United States Code) is or is intended to be drawn in question, in an action, suit or proceeding, entitled ____________________v.______________, No._____ , now pending in the United States District Court for the Northern District of Illinois,____________ Division, to which action, suit or proceeding neither the U.S. nor any agency thereof, nor any officer or employee thereof as such officer or employee is a party.
