Rule 2.44 Procedures For Review And Appeals

A. Orders Entered by the Duty Magistrate

The request for a review of an order entered by the duty magistrate designated pursuant to section A of Rule 2.40 of these Rules shall be brought to the attention of the emergency judge by the aggrieved party as soon as practicable following the entry of the order by the magistrate. The aggrieved party shall be responsible for notifying the other parties involved in the proceeding that a review will be requested and for notifying them of the approximate time noticed before the emergency judge.

B. Other Reviews

All other reviews shall be handled in accordance with the provisions of Rule 72 of the Federal Rules of Civil Procedure.

C. Appeals from Judgments in Misdemeanor Cases (18 U.S.C. §3402)

Procedures for appeals in misdemeanor cases shall be those established by Rule 7 of the Rules of Procedure for the Trial of Misdemeanors Before United States Magistrates.

D. Appeals in Civil Consent Cases

Procedures in appeals in civil cases where the parties have consented to have the magistrate conduct any or all proceedings shall be in accordance with Rules 73, 74, 75, and 76 of the Federal Rules of Civil Procedure. Where an appeal is to a judge of the district court, the appeal will be assigned directly to the calendar of the judge to whom the case was assigned prior to its being reassigned on consent to the magistrate.
