RULES 1.00 To 1.09 ORGANIZATION OF THE COURT


Rule 1.02 The Executive Committee

A. Duties and Responsibilities

This Court shall administer and conduct its business by action of its Executive Committee. The Executive Committee shall prescribe its own rules of procedure.

The Executive Committee shall report a summary of its actions and activities to the Court at regularly scheduled meetings of the judges. Decisions and actions of the Executive Committee taken on behalf of the Court may be approved or disapproved by a majority of the judges of the Court.

B. Meetings of the Executive Committee

The members of the Executive Committee shall meet not less than once a month, except as they otherwise determine. Such meetings shall be prior to the regular monthly meetings of the Court. The Chief Judge may call the members of the Committee to attend a special meeting where a ruling of the Committee is required and such ruling cannot be delayed until the next scheduled regular meeting.

C. Composition of the Executive Committee, Generally

The Executive Committee shall be composed of the Chief Judge, four judges of the Court, the acting Chief Judge and the Clerk of the Court will be members of the Executive Committee ex officio. The Chief Judge or, in his/her absence, the Acting Chief Judge, shall preside over the meetings of the Executive Committee. The presiding judge and each of the four judges chosen in accordance with Section D or E of this Rule shall have one vote, providing that where the Acting Chief Judge is the presiding judge and also a judge chosen in accordance with Sections D or E of this Rule, he/she shall have only one vote.

D. Composition of the Initial Executive Committee

Effective September 15, 1970, the Executive Committee, other than the Chief Judge, shall consist of the four active judges senior in commission. The terms of the initial members of the Executive Committee shall be:

(1) the judge with the most seniority shall serve a term of one year;

(2) the judge ranking second in seniority shall serve a term of two years;

(3) the judge ranking third in seniority shall serve a term of three years;

(4) the judge ranking fourth in seniority shall serve a term of four years.

Except as provided in part E of this Rule, terms shall expire on the 14th day of September of each succeeding year.

E. Composition of Succeeding Executive Committees

As each term of a member of the Executive Committee expires or terminates for any reason, the judge with the most seniority who has not served on the Executive Committee shall become a member. When all judges of the Court have served one term, membership shall be rotated on the basis of seniority of the active judges then members of this Court.

The term of membership shall be four years. When a judge assumes an unexpired term vacated by another judge, he/she shall serve for four years starting on the day following the last day of service of the judge who failed to complete his/her four year term.
