INTRODUCTION TO THE FINAL CHARGE

MEMBERS OF THE JURY:

NOW THAT YOU HAVE HEARD ALL OF THE EVIDENCE TO BE RECEIVED IN THIS TRIAL AND EACH OF THE ARGUMENTS OF COUNSEL IT BECOMES MY DUTY TO GIVE YOU THE COURT'S FINAL INSTRUCTIONS AS TO THE LAW THAT IS APPLICABLE TO THIS CASE AND WHICH WILL GUIDE YOU IN YOUR DECISIONS.

ALL OF THE INSTRUCTIONS OF LAW GIVEN TO YOU BY THE COURT-THOSE GIVEN TO YOU AT THE BEGINNING OF THE TRIAL, THOSE GIVEN TO YOU DURING THE TRIAL, IF ANY, AND THESE FINAL INSTRUCTIONS-MUST GUIDE AND GOVERN YOUR DELIBERATIONS.

IT IS YOUR DUTY AS JURORS TO FOLLOW THE LAW AS STATED IN ALL OF THE INSTRUCTIONS OF THE COURT AND TO APPLY THESE RULES OF LAW TO THE FACTS AS YOU FIND THEM FROM THE EVIDENCE RECEIVED DURING THE TRIAL.

YOU MAY, IN SHORT, ACCEPT OR REJECT THE TESTIMONY OF ANY WITNESS IN WHOLE OR IN PART.

ALSO, THE WEIGHT OF THE EVIDENCE IS NOT NECESSARILY DETERMINED BY THE NUMBER OF WITNESSES TESTIFYING TO THE EXISTENCE OR NON-EXISTENCE OF ANY FACT. YOU MAY FIND THAT THE TESTIMONY OF A SMALL NUMBER OF WITNESSES AS TO ANY FACT IS MORE CREDIBLE THAN THE TESTIMONY OF A LARGER NUMBER OF WITNESSES TO THE CONTRARY.

THE LAW DOES NOT REQUIRE ANY PARTY TO CALL AS WITNESSES ALL PERSONS WHO MAY HAVE BEEN PRESENT AT ANY TIME OR PLACE INVOLVED IN THE CASE, OR WHO MAY APPEAR TO HAVE SOME KNOWLEDGE OF THE MATTERS IN ISSUE AT THIS TRIAL. NOR DOES THE LAW REQUIRE ANY PARTY TO PRODUCE AS EXHIBITS ALL PAPERS AND THINGS MENTIONED IN EVIDENCE IN THE CASE.

THERE ARE, GENERALLY SPEAKING, TWO TYPES OF EVIDENCE FROM WHICH A JURY MAY PROPERLY FIND THE TRUTH AS TO THE FACTS OF A CASE. ONE IS DIRECT EVIDENCE -- SUCH AS THE TESTIMONY OF AN EYEWITNESS. THE OTHER IS INDIRECT OR CIRCUMSTANTIAL EVIDENCE -- THE PROOF OF A CHAIN OF CIRCUMSTANCES POINTING TO THE EXISTENCE OR NON-EXISTENCE OF CERTAIN FACTS.

AS A GENERAL RULE, THE LAW MAKES NO DISTINCTION BETWEEN DIRECT OR CIRCUMSTANTIAL EVIDENCE, BUT SIMPLY REQUIRES THAT THE JURY FIND THE FACTS IN ACCORDANCE WITH THE PREPONDERANCE OF ALL THE EVIDENCE IN THE CASE, BOTH DIRECT AND CIRCUMSTANTIAL.

THE BURDEN IS ON THE PLAINTIFF IN A CIVIL ACTION SUCH AS THIS TO PROVE EVERY ESSENTIAL ELEMENT OF HER CLAIM BY A "PREPONDERANCE OF THE EVIDENCE." HOWEVER, AS YOU WILL BE INSTRUCTED AT THE CLOSE OF EVIDENCE, DEFENDANT MAY IN SOME INSTANCES BEAR THE BURDEN TO PROVE CERTAIN FACTS.

A PREPONDERANCE OF THE EVIDENCE MEANS SUCH EVIDENCE AS, WHEN CONSIDERED AND COMPARED WITH THAT OPPOSED TO IT, HAS MORE CONVINCING FORCE AND PRODUCES IN YOUR MINDS A BELIEF THAT WHAT IS SOUGHT TO BE PROVED IS MORE LIKELY TRUE THAN NOT TRUE. IN OTHER WORDS, TO ESTABLISH A CLAIM BY A PREPONDERANCE OF THE EVIDENCE MEANS TO PROVE THAT THE CLAIM IS MORE LIKELY SO THAN NOT SO. THIS RULE DOES NOT, OF COURSE, REQUIRE PROOF TO AN ABSOLUTE CERTAINTY, SINCE PROOF TO AN ABSOLUTE CERTAINTY IS SELDOM POSSIBLE IN ANY CASE.

IN DETERMINING WHETHER ANY FACT IN ISSUE HAS BEEN PROVED BY A "PREPONDERANCE OF THE EVIDENCE", THE JURY MAY CONSIDER THE TESTIMONY OF ALL THE WITNESS, REGARDLESS OF WHO MAY HAVE CALLED THEM, AND ALL THE EXHIBITS RECEIVED IN EVIDENCE, REGARDLESS OF WHO MAY HAVE PRODUCED THEM.

IF THE PROOF SHOULD FAIL TO ESTABLISH ANY ESSENTIAL ELEMENT OF THE PLAINTIFF'S CLAIM BY A PREPONDERANCE OF THE EVIDENCE, THEN THE PLAINTIFF HAS FAILED TO CARRY HER BURDEN OF PROOF BY A PREPONDERANCE OF THE EVIDENCE AND YOU MUST RETURN A VERDICT FOR THE DEFENDANT.

WHEN I SAY IN THESE INSTRUCTIONS THAT A PARTY HAS THE BURDEN OF PROOF ON ANY PROPOSITION, OR USE THE EXPRESSION "IF YOU FIND", OR "IF YOU DECIDE", I MEAN YOU MUST BE PERSUADED, CONSIDERING ALL THE EVIDENCE IN THE CASE, THAT THE PROPOSITION IS MORE PROBABLY TRUE THAN NOT TRUE.

THE NATURE OF THE CLAIM

THIS IS AN ACTION BROUGHT UNDER TITLE VII OF THE CIVIL RIGHTS ACT OF 1964, AS AMENDED ("TITLE VII"). TITLE VII MAKES IT UNLAWFUL FOR AN EMPLOYER TO DISCHARGE ANY INDIVIDUAL, OR TO DISCRIMINATE AGAINST ANY INDIVIDUAL WITH RESPECT TO HER TERMS, CONDITIONS, OR PRIVILEGES OF EMPLOYMENT BECAUSE OF HER SEX.

TITLE VII PROVIDES THAT THE TERM "BECAUSE OF SEX" INCLUDES BECAUSE OF PREGNANCY, CHILDBIRTH, OR RELATED MEDICAL CONDITIONS. WOMEN WHO ARE PREGNANT MUST BE TREATED THE SAME FOR ALL EMPLOYMENT-RELATED PURPOSES AS OTHER EMPLOYEES (MEN OR WOMEN) WHO ARE NOT PREGNANT BUT WHO ARE SIMILAR IN THEIR ABILITY OR INABILITY TO WORK. THE MERE FACT THAT AN EMPLOYEE IS PREGNANT DOES NOT PRECLUDE AN EMPLOYER FROM DISCHARGING HER.

THE PLAINTIFF, REGINA SHEEHAN, ALLEGES THAT THE DEFENDANT, DONLEN CORPORATION, VIOLATED TITLE VII BY DISCRIMINATING AGAINST HER BECAUSE OF HER SEX WHEN THEY FIRED HER WHILE SHE WAS PREGNANT WITH HER THIRD CHILD.

DONLEN DENIES THAT IT DISCRIMINATED AGAINST MS. SHEEHAN IN VIOLATION OF TITLE VII AND CONTENDS THAT SHE WAS TERMINATED FOR LEGITIMATE, NON-DISCRIMINATORY REASONS.

THE ESSENTIAL ELEMENTS OF THE CASE

TO PREVAIL ON HER CLAIM, MS. SHEEHAN MUST PROVE BY A PREPONDERANCE OF THE EVIDENCE THAT HER PREGNANCY WAS A DETERMINING FACTOR IN DONLEN'S DECISION TO DISCHARGE HER.

PLAINTIFF'S PREGNANCY WAS A DETERMINING FACTOR IF YOU FIND THAT DONLEN WOULD NOT HAVE DISCHARGED MS. SHEEHAN BUT FOR HER PREGNANCY; IT DOES NOT REQUIRE THAT PREGNANCY WAS THE ONLY REASON FOR DONLEN'S DECISION TO DISCHARGE HER.

HOWEVER, EVEN IF YOU DECIDE THAT MS. SHEEHAN'S PREGNANCY HAS BEEN SHOWN TO HAVE BEEN A DETERMINING FACTOR IN DONLEN'S DECISION TO DISCHARGE MS. SHEEHAN, IF DONLEN PROVES BY A PREPONDERANCE OF THE EVIDENCE THAT IT WOULD HAVE REACHED THE SAME DECISION TO DISCHARGE MS. SHEEHAN IF SHE HAD NOT BEEN PREGNANT, YOU SHOULD FIND IN FAVOR OF DONLEN.

DEFENSES

YOU MUST CONSIDER ANY LEGITIMATE, NON-DISCRIMINATORY REASON OR EXPLANATION STATED BY DONLEN FOR ITS DECISION TO DISCHARGE MS. SHEEHAN. A LEGITIMATE, NON-DISCRIMINATORY REASON IS ANY REASON OR EXPLANATION UNRELATED TO MS. SHEEHAN'S PREGNANCY. IN CONSIDERING THE LEGITIMATE, NON-DISCRIMINATORY REASON STATED BY DONLEN FOR ITS DECISION, YOU ARE NOT TO SUBSTITUTE YOUR PERSONAL JUDGMENT FOR DONLEN'S BUSINESS JUDGMENT AND YOU ARE NOT TO ALLOW YOUR OWN PERSONAL EMPLOYMENT EXPERIENCE TO IMPACT YOUR DECISION.

IF YOU FIND THAT DONLEN HAS STATED A LEGITIMATE, NON-DISCRIMINATORY REASON FOR ITS DECISION, THEN YOU MUST FIND FOR DONLEN UNLESS MS. SHEEHAN PROVES BY A PREPONDERANCE OF THE EVIDENCE THAT DONLEN'S STATED REASON WAS NOT THE TRUE REASON FOR THE DECISION, BUT IS ONLY A PRETEXT OR PHONY REASON FOR DISCRIMINATING AGAINST MS. SHEEHAN BECAUSE OF HER PREGNANCY.

MS. SHEEHAN CAN PROVE PRETEXT DIRECTLY BY PROVING THAT HER PREGNANCY WAS MORE LIKELY THE REASON FOR DONLEN'S DECISION TO DISCHARGE HER THAN THE REASON STATED BY DONLEN; OR MS. SHEEHAN CAN PROVE PRETEXT BY PROVING THAT DONLEN'S STATED REASON FOR ITS DECISION IS JUST NOT BELIEVABLE. YOU MAY FIND THAT DONLEN'S REASON IS NOT BELIEVABLE IF YOU FIND THAT IT HAS NO BASIS IN FACT, OR IF IT DID NOT ACTUALLY MOTIVATE THE DECISION, OR IF IT IS INSUFFICIENT TO MOTIVATE THE DECISION.

MS. SHEEHAN MUST ALWAYS PROVE BY A PREPONDERANCE OF THE EVIDENCE THAT DONLEN DISCHARGED HER BECAUSE OF HER PREGNANCY. HOWEVER, IF MS. SHEEHAN PROVES THAT THE STATED REASON IS PRETEXTUAL, SHE NEED NOT PROVIDE ADDITIONAL PROOF THAT DONLEN INTENTIONALLY DISCRIMINATED AGAINST HER BECAUSE OF HER PREGNANCY.

DAMAGES

IF YOU FIND THAT DONLEN DID NOT DISCRIMINATE AGAINST MS. SHEEHAN, YOU NEED NOT CONSIDER THE QUESTION OF DAMAGES.

IF YOU HAVE FOUND THAT DONLEN DID DISCRIMINATE AGAINST MS. SHEEHAN BECAUSE OF HER PREGNANCY, THEN YOU MUST CONSIDER WHETHER TO AWARD HER DAMAGES. THE LAW PLACES A BURDEN UPON THE PLAINTIFF TO PROVE SUCH FACTS AS WILL ENABLE YOU TO ARRIVE AT THE AMOUNT OF DAMAGES WITH REASONABLE CERTAINTY AND WITHOUT SPECULATION. WHILE IT IS NOT NECESSARY THAT THE PLAINTIFF PROVE THE AMOUNT OF THOSE DAMAGES WITH MATHEMATICAL PRECISION, THE PLAINTIFF IS REQUIRED TO PRESENT SUCH EVIDENCE AS MIGHT REASONABLY BE EXPECTED TO BE AVAILABLE UNDER THE CIRCUMSTANCES.

YOU SHOULD NOT INTERPRET THE FACT THAT I HAVE GIVEN INSTRUCTIONS ABOUT THE PLAINTIFF'S DAMAGES AS AN INDICATION IN ANY WAY THAT I BELIEVE THAT THE PLAINTIFF SHOULD, OR SHOULD NOT, WIN THIS CASE.

ACTUAL DAMAGES

IF YOU FIND IN FAVOR OF MS. SHEEHAN ON HER PREGNANCY DISCRIMINATION CLAIM, THEN YOU MUST AWARD HER SUCH A SUM AS YOU FIND BY THE PREPONDERANCE OF THE EVIDENCE WILL FAIRLY AND JUSTLY COMPENSATE HER FOR ANY DAMAGES YOU FIND SHE SUSTAINED AS A DIRECT RESULT OF DONLEN'S DECISION TO DISCHARGE HER. MS. SHEEHAN'S CLAIMS FOR DAMAGES INCLUDE TWO DISTINCT TYPES OF DAMAGES AND YOU MUST CONSIDER THEM SEPARATELY:

FIRST, YOU MUST DETERMINE THE AMOUNT OF ANY WAGES AND FRINGE BENEFITS MS. SHEEHAN WOULD HAVE EARNED IN HER EMPLOYMENT WITH DONLEN IF SHE HAD NOT BEEN DISCHARGED ON SEPTEMBER 13, 1994, THROUGH THE DATE OF YOUR VERDICT, MINUS THE AMOUNT OF EARNINGS AND BENEFITS THAT SHE RECEIVED FROM OTHER EMPLOYMENT DURING THAT TIME.

SECOND, YOU MUST DETERMINE THE AMOUNT OF ANY OTHER DAMAGES SUSTAINED BY MS. SHEEHAN, SUCH AS OUT-OF-POCKET EXPENSES, EMOTIONAL PAIN, SUFFERING, INCONVENIENCE, AND MENTAL ANGUISH.

WHEN CONSIDERING THE AMOUNT OF MONETARY DAMAGES TO WHICH MS. SHEEHAN MAY BE ENTITLED, YOU SHOULD CONSIDER THE NATURE, CHARACTER, AND SERIOUSNESS OF ANY EMOTIONAL DISTRESS SHE FELT. YOU MUST ALSO CONSIDER ITS EXTENT OR DURATION, AS ANY AWARD YOU MAKE MUST COVER THE DAMAGES ENDURED BY MS. SHEEHAN SINCE THE WRONGDOING TO THE PRESENT TIME.

YOU MUST ENTER SEPARATE AMOUNTS FOR EACH TYPE OF DAMAGES IN THE VERDICT FORM AND MUST NOT INCLUDE THE SAME ITEMS IN MORE THAN ONE CATEGORY.

MITIGATION OF DAMAGES

THE PLAINTIFF MUST MAKE EVERY REASONABLE EFFORT TO MINIMIZE OR REDUCE HER DAMAGES FOR LOSS OF COMPENSATION BY SEEKING EMPLOYMENT. THIS IS CALLED MITIGATION OF DAMAGES.

DONLEN BEARS THE BURDEN OF PROVING BY A PREPONDERANCE OF THE EVIDENCE THAT MS. SHEEHAN FAILED TO EXERCISE REASONABLE DILIGENCE IN SEEKING EMPLOYMENT. TO MEET THIS BURDEN, DONLEN MUST SHOW: (1) THAT MS. SHEEHAN WAS NOT REASONABLY DILIGENT IN SEEKING OTHER EMPLOYMENT; AND (2) HAD SHE BEEN REASONABLY DILIGENT, THERE WAS A REASONABLE CHANCE SHE MIGHT HAVE FOUND COMPARABLE EMPLOYMENT. IN DETERMINING WHAT IS "COMPARABLE EMPLOYMENT," THE LAW DOES NOT REQUIRE MS. SHEEHAN TO GO INTO ANOTHER LINE OF WORK, ACCEPT A DEMOTION, OR TAKE A DEMEANING POSITION.

YOU MUST FIND THAT MS. SHEEHAN HAS ACTED WITH REASONABLE DILIGENCE, EVEN IF MS. SHEEHAN DID NOT SUCCEED IN FINDING COMPARABLE EMPLOYMENT, IF YOU FIND THAT SHE MADE AN HONEST, GOOD FAITH EFFORT TO SEEK EMPLOYMENT. IF YOU DETERMINE THAT DONLEN HAS FAILED TO PROVE THAT MS. SHEEHAN DID NOT EXERCISE REASONABLE DILIGENCE, YOU MUST NOT REDUCE MS. SHEEHAN'S DAMAGES. IF YOU DETERMINE THAT THE PLAINTIFF DID NOT MAKE REASONABLE EFFORTS TO OBTAIN ANOTHER SIMILAR JOB, YOU MUST DECIDE WHETHER ANY DAMAGES RESULTED FROM HER FAILURE TO DO SO. YOU MUST NOT COMPENSATE THE PLAINTIFF FOR ANY PORTION OF HER DAMAGES THAT RESULTED FROM HER FAILURE TO MAKE REASONABLE EFFORTS TO REDUCE HER DAMAGES.

PUNITIVE DAMAGES

IN ADDITION TO THE DAMAGES MENTIONED IN THE PREVIOUS INSTRUCTION, THE LAW PERMITS THE JURY UNDER CERTAIN CIRCUMSTANCES TO AWARD AN INJURED PERSON PUNITIVE DAMAGES IN ORDER TO PUNISH THE DEFENDANT FOR SOME EXTRAORDINARY MISCONDUCT AND TO SERVE AS AN EXAMPLE OR WARNING TO OTHERS NOT TO ENGAGE IN SUCH CONDUCT.

IF YOU FIND IN FAVOR OF MS. SHEEHAN ON HER PREGNANCY DISCRIMINATION CLAIM, AND IF YOU FIND THAT DONLEN ACTED WITH MALICE OR WITH RECKLESS INDIFFERENCE TO MS. SHEEHAN'S RIGHT NOT TO BE DISCRIMINATED AGAINST ON THE BASIS OF HER PREGNANCY, THEN IN ADDITION TO ANY DAMAGES TO WHICH YOU FIND MS. SHEEHAN ENTITLED, YOU MAY AWARD HER AN ADDITIONAL AMOUNT AS PUNITIVE DAMAGES, IF YOU FIND IT IS APPROPRIATE TO PUNISH DONLEN OR DETER DONLEN AND OTHERS FROM LIKE CONDUCT IN THE FUTURE.

PUNITIVE DAMAGES MUST BEAR A REASONABLE RELATIONSHIP TO THE PLAINTIFF'S ACTUAL INJURY. HOWEVER, NO SINGLE NUMERICAL EQUATION HAS BEEN MADE TO EASILY LINK PUNITIVE TO COMPENSATORY DAMAGES. IN DETERMINING A REASONABLE RELATIONSHIP TO THAT ACTUAL INJURY, YOU MUST CONSIDER ALL RELEVANT FACTORS. THESE INCLUDE:

(1) THE IMPACT OR SEVERITY OF THE DEFENDANT'S CONDUCT,

(2) THE AMOUNT OF TIME THE DEFENDANT CONDUCTED ITSELF IN THIS MANNER,

(3) THE AMOUNT OF COMPENSATORY DAMAGES,

(4) THE EFFECT OF THE DAMAGES AWARD ON THE DEFENDANT'S FINANCIAL CONDITION, AND

(5) ANY PUNISHMENT THE DEFENDANT MAY RECEIVE FROM OTHER SOURCES.
