Mandatory Initial Discovery Pilot Project

The Court is participating in the Mandatory Initial Discovery Pilot Project (“MIDP”).  The MIDP applies to all civil cases filed on or after June 1, 2017, except (1) cases exempted by Rule 26(a)(1)(B) including pro se prisoner cases where the Court has recruited counsel for the plaintiff, (2) actions under the Private Securities Litigation Reform Act (“PSLRA”), (3) patent cases governed by a local rule, and (4) cases transferred for consolidated administration in this district by the Judicial Panel on Multidistrict Litigation.  The discovery obligations in the MIDP supersede the disclosures required by Rule 26(a)(1) and are framed as court-ordered mandatory initial discovery.  The Court will not permit parties to opt out of the discovery obligations of the MIDP.
