Emergency Motions

The 3-day notice requirement does not apply to the filing of emergency motions. To qualify as an emergency, a motion must arise from an unforeseen circumstance. In the event a party needs to present an emergency motion, the moving party must phone the Courtroom Deputy prior to filing the motion and advise her of the general nature of the motion and the reason it requires emergency treatment. A party seeking to present an emergency motion must make reasonable efforts to provide the opposing party with actual notice of the motion.
