Standing Order on Initial Status Reports
|
|
In order to make the initial status hearing as productive a possible, the Court directs the parties to file, at least three business days before the status hearing, a joint status report, not to exceed 5 pages, containing the following information:
FOR REFERRAL CASES
-
A brief summary of the claims asserted in the complaint and any counterclaims or third-party complaints.
-
A brief statement of the relief sought, including an itemization of damages.
-
A description of the matter referred to the magistrate judge for ruling as described in the referral order.
-
The status of any briefing on the matter(s) referred.
-
Any existing discovery cut-off, pre-trial order, or trial date.
-
If the case has been referred for management of discovery, provide a brief description of discovery that has been completed and any depositions that have been set; also state whether the parties anticipate discovery of Electronically Stored Information (“ESI”) in this case, and if so, what agreements have been reached regarding ESI and whether there are any areas of disagreement regarding ESI.
-
The status of settlement discussions.
FOR CONSENT CASES
-
All of the above, as applicable.
-
If no discovery schedule has been set yet, the parties must confer and submit a report in compliance with Rule 26(f) of the Federal Rules of Civil Procedure.
-
The earliest date the parties will be available for trial and whether a jury has been demanded.
Please note that joint status reports are not required in cases that are referred solely for a settlement conference. For cases referred solely for settlement, see Judge Jantz’s Standing Order for Settlement Conferences. A settlement conference date and dates for the exchange of settlement conference letters will be set at the initial status hearing or conference call in those cases.
