LR5.4. Motions: Filing Notice & Motion
Filing of papers shall be with the clerk unless a particular judge has
provided for filing in the judge’s chambers. The clerk shall maintain a list of the delivery requirements of
each judge and post a copy in a public area of the clerk’s office.
Where a motion is delivered to the clerk that does not comply with the
scheduling requirements established by the judge pursuant to LR78.1 or is scheduled
before a judge who, pursuant to this rule, has directed that the motions are to
be delivered to the minute clerk assigned to the judge or to the judge’s chambers, the clerk shall inform the person offering the motion of the
correct procedure. If the person insists on delivering it to the clerk, the clerk
shall accept it and attach to it a note indicating that the person delivering it
was advised of the scheduling or delivery requirements.
