     Docket Date: 12/15/04
MINUTE ORDER of 12/14/04 by Hon. Samuel Der-Yeghiayan :
This matter is before the court on plaintiff's motion for
entry of default judgment against defendants Laurence
Capriotti, Wholesale Real Estate Services, Inc., and ITI
Enterprises. Jack Hargrove ("Hargrove") has filed a brief
stating his position in regards to his potential alter ego
liability. However, Hargrove does not provide any reason
for a denial of the instant motion. Plaintiff indicates
that it has not yet sought to hold Hargrove liable under an
alter ego theory and that any defense presented by Hargrove
at this juncture is premature. We agree and note that even
Hargrove admits that there is no live issue in this regard
and states in his brief that "while he seeks no current
ruling or decision by the Court with regard to matters set
out in this response and objections, his position is
clearly established." (Harg. Brief.15). Therefore, we grant
plaintiff's motion for entry of default judgment against
defendants Laurence Capriotti, Wholesale Real Estate
Services, Inc. and ITI Enterprises [763-1]. Mailed notice

     Docket Date: 12/15/04
MINUTE ORDER of 12/14/04 by Hon. Samuel Der-Yeghiayan: This
matter is before the court on plaintiff-appellant Joe
Clark's ("Clark") motion to voluntarily terminate his
appeal and seek enforcement of settlement. On 03/09/04, we
dismissed Clark's case with prejudice. On 03/25/04, Clark
filed a notice of appeal. The Seventh Circuit has stated
that "[t]he filing of a notice of appeal generally divests
the district court of its jurisdiction over the case." Roe
     v. Town of Highland, 909 F.2d 1097, 1100 (7th Cir. 1990).
Clark's motion to voluntarily terminate this appeal and to
seek enforcement of settlement was filed on 07/29/04,
approximately four months after he filed his notice of
appeal. Therefore, Clark's motion to voluntarily terminate
his appeal and seek enforcement of settlement is denied for

     Docket Date: 12/16/04
MINUTE ORDER of 12/14/04 by Hon. Samuel Der-Yeghiayan: This
matter is before the court on Stanley Browzowski's and Camy
Browzowski's (collectively "plaintiffs") motion to proceed
in forma pauperis ("ifp motion"). Plaintiffs, on their
application in support of their IFP motion, have indicated
that Stanley Browzowski currently receives income in the
amount of $150.00 a week and that Camy Browzowski currently
has $2,000.00 in cash in her name in an account,. IFP Mot.
pp.1-2. Accordingly, based on plaintiffs' financial
affidavit, we find that plaintiffs have failed to provide
sufficient evidence to warrant a grant of the ifp motion.
Therefore, plaintiffs' ifp motion is denied [4-1] for
fees. Because plaintiffs are proceeding pro se, plaintiffs
are given leave to pay the $150.00 filing fee by 01/13/05.
Plaintiffs are warned that if they fail to pay the $150.00
filing fee by 01/13/05, the action will be dismissed.
