     Docket Date: 12/14/04
MINUTE ORDER of 12/13/04 by Hon. Amy J. St. Eve as to Mario
Jara : Minute order entered on 12/9/04 is vacated [122-1].
Before the Court is Petitioner Mario Jara's request for a
thirty (30) day extension of time until 1/30/05, to file
     his 28 U.S.C. 2255 petition. Under the Anti-terrorism and
Effective Death Penalty Act, a motion under 28 U.S.C. 2255
must be filed with one year of "the date on which the
judgment of conviction becomes final." Here, the
Courtaccepted Petitioner's guilty plea and sentenced
Petitioner on 3/25/04. His conviction became final ten
busines days later because he did not appeal the judgment.
See Federal Rule of Appellate Procedure 4(b). Accordingly,
Petitioner's request for an extension of time of 30 days to
file his 2255 petition is unnecessary because the one year
time period in which he must file his 2255 petition will
not expire by 1/30/05. Accordingly, Defendant Mario Jara's
request for a thirty (30) day extension to file his 28
U.S.C. 2255 petition is denied. Mailed notice
