MINUTE ORDER of 12/8/04 by Hon. Samuel Der-Yeghiayan :
Status hearing set for 12/09/2004 is stricken and reset to
9:00 a.m. on 01/20/2005. This matter is before the court
on petitioner Lawrence Howard's ("Howard") motion for
appointment of counsel. On 11/05/2004, in a minute order,
we granted Howard leave to re-file a request to proceed in
forma pauperis and leave to re-file a motion for
appointment of counsel. Howard has re-filed a motion for
appointment of counsel, but has failed to attach to that
motion any documentation showing that he is indigent.
Therefore Howard's motion for appointment is denied without
prejudice. Howard is granted laeave to re-file a request to
proceed in forma pauperis by 01/13/2005. Howard is warned
that if he fails to re-file a request to proceed in forma
pauperis or fails to pay the five dollar filing fee by
01/13/2005, his petition for writ of habeas corpus will be
     dismissed. Mailed notice
