matter comes before the court on the motion of Robert
Krilich to correct [70-1], vacate [70-2], set aside his
sentence [70-3] pursuant to 28 U.S.C. section 2255. His
motion sets forth two grounds for relief. The first
contends that the sentencing judge was without jurisdiction
to render the third sentence he received because of
particular time limits set forth within Fed.R.Crim.Proc.35.
The second avers that Krilich's sentence was increased in a
way that runs afoul of the Supreme Court's recent decision
in Blakely v. Washington, - U.S.-, 124 S.Ct. 2531, 2537
(2004). We dismiss the first portion of his motion for lack
of jurisdiction. We dismiss the second portion of the
motion relying on Blakely without prejudice to its
representment should the case ultimately be given
retroactive effect. This terminates all pending motions.

Plaintiff Roderick Johnson ("Johnson") filed this action
against defendants GES and the Metropolitan Pier Exposition
Authority, alleging violations of Title VII and 42 U.S.C.
section 1981. Claiming indigence, Johnson has filed an
application to proceed in forma pauperis as well as a
motion for appointment of counsel. Before granting a
petitioner leave to file in forma pauperis, a district
court must determine that the party is indigent. Smith-Bey
v. Hospital Adm'r. 841 F.2d751, 757 (7th Cir. 1988). If the
plaintiff cannot demonstrate an inability to pay the filing
fee, the petition cannot be granted. Here, Johnson's
financial affidavit states that he earns approximately
$4000 per month, or a personal income of around $48,000 a
year. In light of this information, we conclude that
Johnson is not indigent, precluding a grant of IFP status
as well as appointment of counsel. Thus, his petition
[4-1] and motion for appointment of counsel [5-1] are both
denied. Pursuant to Local Rule 3.3(e), if Johnson does not
pay the $150 filing fee by 01/28/05, this action will be
dismissed. The dismissal will bar any future filing of this
