matter comes before the court on the motion of Robert
Krilich to correct [70-1], vacate [70-2], set aside his
sentence [70-3] pursuant to 28 U.S.C. section 2255. His
motion sets forth two grounds for relief. The first
contends that the sentencing judge was without jurisdiction
to render the third sentence he received because of
particular time limits set forth within Fed.R.Crim.Proc.35.
The second avers that Krilich's sentence was increased in a
way that runs afoul of the Supreme Court's recent decision
in Blakely v. Washington, - U.S.-, 124 S.Ct. 2531, 2537
(2004). We dismiss the first portion of his motion for lack
of jurisdiction. We dismiss the second portion of the
motion relying on Blakely without prejudice to its
representment should the case ultimately be given
retroactive effect. This terminates all pending motions.
