Chase Bank") was named as the party-plaintiff in the
complaint. On 01/04/05, plaintiff filed an affidavit
confirming that J.P. Morgan Chase Bank held legal and
equitable title to the note on the day the complaint was
filed. Plaintiff's complaint attempts to allege this
Court's diversity jurisdiction. See 28 U.S.C. Section 1332.
However, plaintiff does not properly allege the citizenship
of J.P. Morgan Chase Bank. See Firstar Bank, N.A. v. Faul,
253 F. 3d 982 (7th Cir. 2001); Pl's Compl., at Paragraph
1.) Therefore, complete diversity has not been established.
Because this defect may be remediable, Plaintiff is granted
leave to file an amended complaint on or before 01/26/05.
