matter comes before the court on the second application of
plaintiff William Hawkins to proceed in forma pauperis
[6-1] and for appointment of counsel [5-1]. Pursuant to our
order of 12/07/04, Hawkins has already been granted in
forma pauperis status allowing him to proceed without full
prepayment of filing fees. Accordingly, the instant
petition [6-1] is denied as moot. With respect to his
motion for appointment of counsel [5-1], Hawkins' current
submission states only that he tried to obtain an attorney,
but the fee was too much for him to afford. He supplies no
information regarding the attorney's name or other
information, and we cannot agree that an overture to only
one attorney constitutes a reasonable attempt to retain
counsel. In addition, we remain convinced that the other
factors that must be taken into account when considering a
motion to appoint counsel weigh against appointment, even
if Hawkins could show that he had diligently sought
representation. Accordingly, the motion [5-1] for
